We buy homes and property throughout the United Kingdom, these terms and conditions set out our home buying service and the terms on which we will make an offer to buy your property. In addition to how you may access, browse and use our website.

 

Our website, www.propertybrix.co.uk is a trading name, owned and maintained by Janus Lloyd Limited, a limited company registered in England and Wales under company number 10307232 and with its registered office at 50 Princes Street, Ipswich, Suffolk IP1 1RJ (“we“, “us” or “our“).

 

By using and browsing our site or contacting us in relation to our home buying services, you confirm that you accept and agree to comply with these Terms & Conditions, which together with our Privacy Policy govern how Propertybrix does business with our customers.

 If you do not agree to these Terms & Conditions you must not use our home buying service or our website.

 

The use of this website is subject to the following terms of use:

  1. The content of the pages of this website is for your general information and use only. It is subject to change without notice.
  2. Neither we nor any third parties provide any warranty or guarantee as to the accuracy, timeliness, performance, completeness or suitability of the information and materials found or offered on this website for any particular purpose. You acknowledge that such information and materials may contain inaccuracies or errors and we expressly exclude liability for any such inaccuracies or errors to the fullest extent permitted by law.

Home Buying Service

 When you submit your details regarding you and your property to us via the website forms or by direct telephone contact, we will assess and provide you with an “indicative offer” which we are prepared to purchase your property . The indicative offer is based on our initial valuation of the estimated market value the property. The indicative Offer is not a formal valuation of the property.

  1. If you agree to our indicative offer and would like to proceed with our home buying service, we will arrange for a valuation and appraisal on your property. We reserve the right to acquire the valuation through an independent surveyor registered with RICS (Royal Institute of Chartered Surveyors) and views and estimates from estate agents local to your property or by a desktop valuation by an independent surveyor  of your property. The results and findings of the assessment will be discussed and made available to you.
  2. When the valuation and appraisal has been completed we will provide you with our formal offer of your property. The Formal Offer price is not a valuation of the property but the price we are prepared to pay for it. You are under no obligation, if you accept our Formal Offer, this amount will be the purchase price of the property.

In the case where there is more than one person acting as the seller e.g. Joint title ownership of the property, each person or entity shall have joint and several liability under these terms and any subsequent contract, therefore meaning each person who is a seller is responsible for fulfilling his or her obligations under this contract individually and together.

Within our Formal Offer we may have have assumed that an exemption from Stamp Duty Land Tax (SDLT) applies to the property, however should it later be realised that the exemption does not apply, we may reduce the Formal Offer by an amount of SDLT payable by us.

 

*?* Formal offer is conditional upon final survey and is subject to any adverse entries being revealed, to include but not limited to searches carried out against the property, the land and title ownership, local authority and other applicable searches. Mortgage charges on the property, a valuation, survey and appraisal acceptable to the buyer and any other such matters which are subsequently revealed to us which would affect the market value of the property.

The Formal Offer will be valid for acceptance for 14 days, after which, this time period may be extended, and/or we may either withdraw or revise the formal offer at our discretion.

 

Once the Formal Offer has been accepted by you, we ask that you stop all marketing the sale of the property in the open market and, where necessary, you contact any and all estate agents or marketing agents to cease marketing the property. If after you accept a Formal Offer the property continues to be marketed by you or any agent on your behalf, we may withdraw or revise our Formal Offer.

 

The full terms and conditions of the Formal Offer will be set out in the Formal offer Terms & Conditions which you should read carefully.

By accepting a Formal Offer you agree to and consent that we may prior to completion to place your property on a property Portal website and/or to allow the property to be marketed by an Estate Agency chosen by us for the purpose of premarketing of the property for resale, rental or other purposes prior to entering into a sale contract with you. Should you subsequently decide that you do not want us to premarket the property, we may amend, withdraw or revise our Formal Offer.

The transaction is not legally binding until there is an exchange of contracts between us and you. Prior to the exchange of contracts, there is no obligation, and, you or we can withdraw from the transaction at any time.

 

Legal advice

We advise that you must take independent legal advice. You may instruct a solicitor of your choice or a solicitor recommended by us to act on your behalf. If you use a solicitor recommended by us we will pay the legal fees. If you use your chosen solicitor, we will contribute up to £600 (plus VAT) towards the legal fees. If you instruct an independent solicitor not recommended by us you will have to pay their fee. 

 

We will have no liability to you for any loss of business, loss of profit, business interruption, or loss of business opportunity.

 

 

Legal Matters

As the Seller you will be required to give us vacant possession of the property on completion of the sale. The sale of your property will be with full title.
